Service Agreement - Rev. 1.2, Last Updated 2/28/05

JISP.net Goal: To provide our subscribers with the best quality 56k V.90 Internet service possible, by using the most up to date equipment and service. The only restrictions on the 56k baud rate will be the modem in your computer and the quality of the phone lines.

1) JISP.net agrees to provide our subscribers with access to the Internet via a 56k V.90 connection and the necessary technical assistance to make a connection. Be advised to check your Verizon phone billing to be sure you are on a per call charge and not a per minute charge. JISP.net will not be responsible for subscriber phone bills.

2) The subscribers of JISP.net agree to provide all necessary preparations required for JISP.net installation and maintenance. Any cost incurred for the purpose of relocation or reinstallation will be the responsibility of subscriber. JISP.net is not responsible for problems arising from the use of software or hardware not recommended by JISP.net. If it is the judgment of JISP.net that problems incurred are the fault of the subscriber, JISP.net will not be held responsible for costs incurred. If technical assistance is requested, the judgment of the technician assigned by JISP.net will be considered a binding solution for the customer and JISP.net.

3) JISP.net services will be provided at the rates set forth below. Although we do not foresee any rate changes, should a rate change occur, the subscriber will be notified in writing 30 days before any changes take effect. Should any rate changes take place a new contract will be assigned. If the subscriber decides to cancel their contract, JISP.net must be notified in writing 10 days before the cancellation takes effect. Refunds will be made only if, in the judgment of JISP.net, the refund is justified. If the subscription is for one year or six months, payment will be due before connection. Should the payment be 15 days late, the Internet connection will be terminated and a $10 fee plus the unpaid balance must be paid before reconnection.

4) In the event JISP.net cannot provide an Internet connection because of an act of God, act of nature, national emergency, or the fault of a JISP.net vendor, no refunds will be made. If the Internet connection cannot be maintained for reasons of JISP.net equipment failure or other reasons of JISP.net responsibility, refunds for lost service will be assessed. If service is lost because of JISP.net responsibility, subscribers will have extensions to service time as reimbursement.

5) Internet service provided by JISP.net is for use by one household or business only. Accounts cannot be shared, transferred or sold without the consent of JISP.net. JISP.net will provide unlimited Internet access with the following exclusions: Any account determined to be shared or connected for a 24 hour period repeatedly or to be used, in the opinion of JISP.net, unreasonably may be subject for disconnection without refund and reinstated only after the subscriber gives JISP.net a reasonable explanation of the event. 24 by 7 connections can be negotiated if necessary.

6) JISP.net will not be held responsible for any unlawful use of the Internet. JISP.net only provides the connection to the Internet and is not responsible for how the subscriber uses the service. If in the judgment of JISP.net any unlawful or abusive activities are being committed through the use of our service, termination of service will result. Any disclosure, distribution, reuse, re-engineering, or tampering of JISP.net information, hardware, or software will result in legal proceedings against such person or persons.

7) Billing will be sent approximately 15 days before the due date. Payment may be made by cash, check, Mastercard, Visa, or money order to JISP.net, 102 S. Main St., Stockton, Illinois, 61085. Payment by cash or check will have $5 deducted from the one year plan and $2.50 deducted from the six month plan. Any returned check fees or insufficient funds expenses will be passed on to the subscriber.

8) All applicable taxes, fees, or other charges will be included in prices put forth unless specified and will be explained to and acknowledged by the subscriber before being assessed.

9) JISP.net does not have cancellation fees. Refunds for subscriptions will not include the current 30 day billing period of the contract. Any subscriber canceling a one year or six month contract will be charged the monthly rate for the months spent as a subscriber and the remaining funds will be returned.

10) JISP.net urges all subscribers to examine their phone bills before or at the time of connection to confirm their phone plan is on a per call charge basis and not per minute charges. JISP.net will not be held responsible for phone bills because of subscriber oversight or Verizon billing practices.
